Biomechanics and Biomechanical Engineering
Biomechanics, a modern subject with ancient roots, has become an extremely useful tool in both vehicle accident reconstruction and injury reconstruction. Biomechanics is simply the application of engineering principles to the human body to understand how it responds to external forces and becomes injured. This presentation examines the scientific basis behind biomechanics and biomechanical engineering, as well as how it can and has been applied to different accident scenarios. Case examples include vehicular accidents, pedestrian accidents, industrial accidents, falling objects, falls/slips/trips, and medical devices. In addition, examples of how computer programs, such as MADYMO, are used to provide a comprehensive qualitative and quantitative analysis, as well as an excellent demonstrative tool.

This presentation will show the successful handling of two equally challenging claims - one, the alleged theft of a $280,000 classic car, that was dropped pre-suit and the other, the alleged theft of a late model sports car that went to trial, given by two different SIU representatives from two different companies and the lawyer that assisted them.

Minor Vehicle Accident Reconstruction and Biomechanics
When minor vehicle accidents are reported, injuries are often claimed. In some cases the reported injuries raise the question: "Is the collision damage proportional to the claimed injury?" This presentation examines the method of recreating these types of accidents for the purpose of determining if the claimed injury is consistent with the impact. The steps taken to determine the impact magnitude are explained, including what documentation is needed and how it is used. The science of biomechanics is described; specifically, how it relates to minor accidents. In addition, examples showing how computer programs, such as MADYMO, can help illustrate the lack of impact severity.

Manufacturing Claims: How Device Makers, Distributors, and Users Increase Litigation Costs
The session will use the development, testing, approval, marketing, and sale of artificial discs to talk about issues inherent in the device approval process that can work to increase both the number and amount of claims in personal injury litigation. By examining the FDA approval process, tools will be provided to examine claims in the following ways: appropriateness of device for recommended patient; approval of device for recommended application; and determining approval dates and conditions for use within FDA protocols. 626 Compliance - Is Your Company Following the Rules?
This class will focus on 626 compliance and why 626 is in place. In this corporate environment, there is going to become intense oversight of financial institutions. As an attorney handling SIU cases, I have been privy to much misuse and abuse of the 626 statute. I have also seen it used properly where it assists companies and the Florida Division of Insurance Fraud, as it was intend. Misusing the 626 Statute can bring a bad faith action, civil litigation and can become exculpatory information in a prosecution of an insurance fraud case. This class will address the statute, the compliance and how to work with DIF (and not against it) to bring a successful prosecution; looking at the difference between burdens of proof in criminal v. civil. Check Endorsements for Coverage A - Is the insurance money making it to the mortgagee? Trends and investigative techniques.

This course will explore the issuing of checks under Coverage A on property policies and the interrelation of the banking institution when the checks are not properly endorsed; or do not make it to the mortgage company. The mortgagee is an additional insured under the homeowners’ policy and is owed a duty of protection of the interest. This class will give a snapshot of trends discovered during an investigation where it was determined that the mortgagee bank endorsement was forged which resulted in the theft of approximately $1 Million dollars in insurance proceeds. We will also walk the class through what steps are to be undertaken when the forgery is confirmed in the middle of a pending appraisal; complying with the 626 obligations and fully investigating the loss and suspicious activity. The civil causes of action will be explored as well; along with a review of the interplay of a public adjuster and their fiduciary relationship to the insured; focusing on their duties and legal responsibilities.
